We respect your privacy and will never sell your data to third parties

CLOAK COMMUNICATIONS LLC (“Company”) uses service providers committed to protecting the privacy of individuals who visit and access the Company’s Platform (“You” or “Visitors”). This Privacy Policy describes Company’s privacy practices in relation to your access and use of Company’s mobile device apps, website, blog and related applications (all together the “Platform”).

By accessing, loading or using the Platform or by submitting personally identifiable information, you agree to the terms of this Privacy Policy and you expressly consent to the use, processing, sub-processing and export of your personally identifiable information and of cookies in accordance with our Privacy Policy.

The Company also enables Visitors to use third-party services (referred to as “add-ons”) as part of running Web applications on the Company’s platform. When you share information with these third-party add-on services, the privacy statement of the third party applies. Company’s Platform may contain links to other Websites. The information practices or content of such other Websites is governed by the privacy statements of such other Websites.

Company reserves the right to change this Privacy Policy. Company will provide notification of the material changes to this Privacy Policy through the Company’s Platform at least thirty (30) business days prior to the change taking effect.

1. Data collected

When expressing an interest in obtaining additional information through the Platform, accessing the Platform or using a Platform functionality, Company may require you to provide the Company with personal contact information, such as your phone number, email, user name, display name and password (“Data About Users”). Data About Users includes device information (including microphone and camera access), log information (such as without limitation IP address and URL), photos and contact book access and may also include location information if you consent to the collection of location information (e.g. if you permit your mobile device or any other device to send us your latitude and longitude).

2. Use of data collected

The Company uses Data About Users to enable the requested Platform functionalities. For example, if you fill out a Web form so that the Company may contact you, the Company will use the information provided to contact you about your interest in the Platform; location information will allow us to enable your publishing preferences and segmentations.

Other functionalities include access to our online forums, find and chat with other users, create an account, maintain and improve the Platform and its content notably in relation to User location, interests, and usage, enhance safety and security (verify accounts, deal with bots and spam, promote a safe user environment, maintain the integrity of our services, comply with legal requirements, monitor and view usage analytics (see usage, analyze trends, help advertisers monitor the effectiveness of their ads) and communicate with you.

The Company may also use Data About Users for promotional or marketing purposes. For example, the Company may use information you provide to contact you to further discuss your interest in the Platform and to send you information regarding the Company and its partners, such as information about promotions or events.

Posts (as that term is defined in our Terms of Access) are public and so are your communications or chats with other Users. Posts and communications or chats to other users are entirely under your control. Do not disclose personal data inside your Posts or communications or chats to other users.

3. Sharing of Data Collected

Company may share Data About Users with the Company’s contracted service providers so that these service providers are able to provide services on our behalf. Unless described in this Privacy Policy, the Company does not share, sell, rent, or trade any information provided with third parties for their promotional purposes. Company may also share Data About Users to your providers with which you have arranged for Company to hold your personal data so as to facilitate these providers’ services to you.

The Company may share Data About Users with other companies in order to work with them, including their affiliates or Company’s affiliates. For example, the Company may need to share Data About Users for customer relationship management purposes.

You authorize Company to hold the Data About Users on its third-party tools listed below, as may be in use from time to time, and hosted in the countries also indicated below (as that information has been provided to Company by each supplier):

The Company reserves the right to use or disclose information provided if required by law or if the Company reasonably believes that use or disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.

4. International transfer of data collected

You authorize Company and Company’s service providers to store, transfer and access Data About Users in the United States, Canada and other countries listed in section 3 above, in which the Company may develop or currently has operations. With your consent, this Privacy Policy shall apply even if the Company transfers Data About Users to other countries. If you are in the EU, Company has taken steps such that its providers offer measures equivalent in protection in satisfaction of EU and national applicable regulations.

5. Communications preferences

The Company offers Visitors who provide contact information a means to choose how the Company uses the information provided. You may manage your receipt of communications by clicking on the “unsubscribe” link located on the bottom of the Company’s emails. Additionally, you may send a request specifying your communications preferences to the email address indicated in Company’s Terms of Access.

6. Data retention

The Company is entitled to retain the information we receive as described in this Privacy Policy above for a reasonable duration, for example, as the case may be, for as long as needed to provide the Platform, comply with our legal obligations, resolve disputes, establish legal defenses, to conduct audits, pursue legitimate business purposes, and enforce our agreements. However, you authorize Company to delete Data About Users along with deletion of your Account or termination of our Agreement as provided in the Terms of Access you agreed.

7. Cookies

The Company sends cookies to your device in order to uniquely identify your browser and improve the quality of our service. A cookie is a small text file that is stored on a Visitor’s device for record-keeping purposes such as site visitation. The Company may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your device until you delete them). Persistent cookies can be removed by following your browser help file directions. Should you opt to disable cookies, some areas of the Platform may not work properly or at all. The Company enables some of its business partners to use cookies in conjunction with your use of the Platform (for example Google Analytics). Company has no control over the use of these cookies. These cookies collect information about the device you use, your use of the Platform, such as which web site you arrived from, which pages were visited within the Platform, and possibly other sites you visit if those sites coordinate with the same third party, but do not collect your name, email address, contact information or other personally identifiable information that by itself would allow the third party to identify or contact you.

If you would prefer not to accept cookies, you may change your browser settings to notify you when you receive a cookie, so that you may choose whether to accept it or not; or set your browser to automatically not accept any cookies. However, please note that some features and services on our Platform may not work properly because we may not be able to recognize and associate you with your account. In addition, the offers we provide when you visit us may not be as relevant to you or tailored to your interests.

Under California law, platform and online service operators are required to disclose how they respond to “do not track” signals. The Company does not currently take actions to respond to Do Not Track signals as a uniform standard for such response has not yet been established.

8. Administrative Purposes

The personal information described above may be used for routine administrative purposes, such as investigating abuses on the Platform, responding to Visitor inquiries and enforcing and applying our Terms of Access.

9. Local rights of California and EU residents

If you are a resident of California or the EU, you have the right to request information about our collection and use of your personal information over the past 12 months as more specifically defined under those local laws, such as categories of personal information collected, categories of sources for the personal information we collected about you, business or commercial purpose for collecting that personal information, categories of third parties with whom we share that personal information, specific pieces of personal information we collected (a.k.a. a data portability request) and disclosures for a business purpose, identifying the personal information categories received by each recipient.

You have a right to access, to ask for corrections and ask for deletion of any of your personal information that we collected subject to exceptions defined in those applicable local laws.

All the rights in this section may be exercised by contacting us through the methods identified in section 10. We strive to deal with all requests within a 45 day period from receipt subject to force majeure or other event outside of our control.

We will never discriminate on the basis of any of these rights being exercised.

For the sake of clarity, we point out that sales opt-out rights and “Shine the Light law” rights, and any and all other rights that may apply to you, may all be exercised in the same manner, but Company does not sell your data and does not disclose your data to third parties for their own direct marketing purposes.
